Welcome to Eloca. By using our app, you agree to the following terms. If you don't agree, please don't use the app.

1. Use of the App

Eloca is an iOS application that helps users improve their communication skills through AI-powered voice analysis, conversational practice, vocabulary building, and structured exercises. You may only use the app for its intended purpose: personal communication skill improvement. Any misuse, including attempts to exploit or manipulate the app's features, is prohibited.

2. No Account Required

You are not required to create an account. Eloca uses an anonymous identifier to manage your subscription status. No personal account information is stored on our servers.

3. Age Requirement

Eloca is rated 12+ on the App Store. Users must be at least 12 years old to use the app. Users under 18 should have parental consent.

4. Third-Party Services

Eloca uses trusted third-party providers to deliver its features.

AI Providers

• OpenAI — Voice transcription (Whisper API) and feedback analysis. What we send: voice recordings, conversation transcripts, practice session context. Data retention: processed via the OpenAI API; not used to train OpenAI's models.
• ElevenLabs — Conversational AI for realistic practice scenarios. What we send: voice recordings, scenario context, conversation history.
• Free Dictionary API — Word definitions for the vocabulary feature. What we send: word queries only (no personal data).

Important: Voice data is sent to these services only when you actively use voice features (scenarios, drills, exercises). Text-only features do not send audio externally.

Subscription & Analytics Services

We also use Apple's App Store, RevenueCat, and Superwall to process, manage, and present subscriptions, and PostHog for anonymous product analytics. These services receive only an anonymous identifier and usage/purchase data — never your name, email, or voice data. See our Privacy Policy for details.

No data is sold or shared with third parties for advertising purposes.

5. AI-Generated Content

Eloca uses artificial intelligence to generate speech feedback and improvement recommendations, conversational AI responses in practice scenarios, and coaching tips and personalized advice. This content is generated automatically and intended for educational purposes only, is not a substitute for professional speech therapy, communication coaching, or mental health services, and may occasionally contain errors or inaccuracies. Eloca is a skill-building tool, not a therapeutic or medical service.

6. Acceptable Use

You agree to use Eloca responsibly. You may not: use the app for unlawful or unintended purposes; attempt to reverse engineer, tamper with, or exploit the app; share inappropriate, offensive, or harmful content during practice; use the app to harass, abuse, or harm others; attempt to extract or replicate our AI prompts or analysis algorithms; or use the app for commercial purposes without permission. We reserve the right to restrict access if the app is used in ways that violate these terms.

7. Voice Recording and Practice Content

By using Eloca's voice features, you confirm that you have the right to record and analyze your own voice; your practice content is appropriate and doesn't violate these Terms; you understand your voice data will be processed by third-party AI services; and you will not record conversations with others without their consent. You are solely responsible for the content you practice with and any recordings you make.

8. Intellectual Property

Your Content — You retain ownership of your voice recordings and practice content. By using our service, you grant us permission to process your content solely to provide speech analysis and improvement features.

Our Content — We own the app's technology, software, course content, lessons, exercises, scenarios, and service features. You may not copy, reproduce, or distribute our content; use our content for commercial purposes; or extract or scrape our lessons, exercises, or vocabulary lists.

9. Subscriptions & Payments

Eloca offers two auto-renewable subscription options — Eloca Pro Monthly and Eloca Pro Yearly. The yearly plan includes a 3-day free trial for new subscribers.

• Subscriptions are processed through Apple's App Store at the prices displayed in the app
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
• You can cancel anytime from iOS Settings → Apple ID → Subscriptions
• Refunds are subject to Apple's refund policy
• The free trial automatically converts to a paid subscription unless cancelled before the trial ends

Cancelling stops future charges but does not refund the current billing period.

10. Disclaimer & Limitation of Liability

Eloca is provided "as is" without warranties of any kind. We make no guarantees regarding accuracy of AI-generated feedback or analysis, effectiveness of practice methods, availability or uninterrupted operation, speech recognition accuracy, or AI service availability (OpenAI, ElevenLabs).

To the fullest extent permitted by law, Eloca is not liable for any indirect, incidental, or consequential damages resulting from your use of Eloca, including but not limited to AI analysis errors or inaccuracies, service interruptions or third-party AI outages, data loss (we recommend backing up your device), and misunderstandings or miscommunications resulting from AI feedback. Our total liability is limited to the amount you paid us in the 12 months before any claim.

11. End User License Agreement (EULA)

Your use of Eloca is subject to Apple's standard EULA, available at apple.com/legal/internet-services/itunes/dev/stdeula, unless we provide a custom EULA, in which case these Terms serve as your EULA.

12. Apple App Store Terms

For iOS App Users: You acknowledge that these Terms are between you and Eloca only, not with Apple Inc. Apple is not responsible for Eloca or its content.

• Maintenance & Support: We, not Apple, are responsible for app support
• Warranty: We, not Apple, are responsible for any product warranties
• Product Claims: We, not Apple, handle any claims related to the app
• Intellectual Property: We, not Apple, are responsible for any IP infringement claims
• Third-Party Beneficiary: Apple is a third-party beneficiary of these Terms and may enforce them

Usage License: Your license to use Eloca is limited to a non-transferable license on Apple-branded devices you own or control, as permitted by Apple's App Store Terms.

13. Termination

You may stop using Eloca at any time by deleting the app from your device. We may terminate or restrict your access if you violate these Terms. Upon deletion: all local data is permanently removed from your device; we cannot recover your progress or data; and any voice data previously sent to AI services follows their retention policies.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the app after changes go into effect constitutes your acceptance of the revised Terms. Significant changes will be communicated through the app or on our website.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be resolved in accordance with these laws.
